First Inditex and now H&M. U.S.-based Alpha Modus has filed lawsuits against the fashion retail giants for allegedly using its in-store technology patents. Specifically, the retail technology company accuses H&M of operating in the United States with five of its technologies.

 

As reported by Alpha Modus in a statement on Wednesday, the patents that H&M has allegedly used in the United States are those dedicated to real-time shopper analytics, in-store design optimization, inventory management, personalized marketing and point-of-sale workflow automation.

 

The company claims that the technologies H&M uses, such as Rfid-based garment tracking, in-store digital video systems, mobile applications, inventory and replenishment software, and interactive mirrors, are part of its proprietary systems.

 

 

 

 

We have a responsibility to enforce our intellectual property when others use our innovations without authorization,“ said William Alessi, CEO of Alpha Modus, who defends the “responsible collaboration” of its partners.

 

Alpha Modus claims that H&M has “directly and indirectly” infringed its five patents, demanding “a permanent injunction to prevent the use” of the patents and “reasonable” financial compensation, plus a “reasonable” increase in the amount of the royalties. At the end of November it became known that Alpha Modus had sued Inditex before the District Court in Texas for alleged patent infringement. At the time, the company alleged that “Zara’s retail environment, including its Rfid-based garment tracking systems, digital surveillance technologies, mobile app features, and inventory replenishment platforms, uses Alpha Modus’ patented methods and systems without authorization.“
